Croatia: EPPO files indictment against one person for agricultural subsidy fraud and document forgery

(Luxembourg, 18 December 2023) – Today, the European Public Prosecutor’s Office (EPPO) in Zagreb (Croatia) filed an indictment at Zagreb’s County Court against one Croatian citizen, for subsidy fraud and forgery of documents.

According to the evidence, the accused submitted, between 2018 and 2021, two requests in the name of a family farm to obtain grants from Croatia’s Rural Development Programme. The applications for both requests, made to Croatia’s Paying Agency for Agriculture, Fisheries and Rural Development, appeared as having been signed by his daughter, who was registered as the official holder of the family farm. The investigation revealed, however, that she had left Croatia at the time the requests were made, and that she was no longer involved in the activities of the family farm.

As the daughter of the accused had a ‘young farmer’ status, the applications he submitted in the family farm’s name, with her as the official holder, would have led to an additional €121 764 in subsidies.

The purpose of the grants was to support investments in agricultural holdings, and was co-financed by the EU’s European Agricultural Fund for Rural Development (EAFRD) at a rate of 85%, and the state budget of the Republic of Croatia at a rate of 15%.

Croatia’s Criminal Code provides for a potential punishment of up to ten years of imprisonment for subsidy fraud, and up to three years of imprisonment for document forgery.

The EPPO is the independent public prosecution office of the European Union. Itis responsible for investigating, prosecuting and bringing to judgment crimes against the financial interests of the EU.

 

 

Hrvatska: EPPO podignuo optužnicu protiv jedne osobe zbog subvencijske prijevare i krivotvorenja isprava

(Luksemburg, 18. prosinca 2023.) – Ured europskog javnog tužitelja (EPPO) u Zagrebu (Hrvatska) je danas kod Županijskog suda u Zagrebu podigao optužnicu protiv jednog hrvatskog državljanina zbog subvencijske prijevare i krivotvorenja isprava.

Prema prikupljenim dokazima, optuženi je u razdoblju od 2018. do 2021. godine u ime OPG-a podnio dva zahtjeva za dobivanje bespovratnih sredstava iz hrvatskog Programa za ruralni razvoj. Izgledalo je da je obje prijave podnesene hrvatskoj Agenciji za plaćanja u poljoprivredi, ribarstvu i ruralnom razvoju potpisala njegova kći, koja je upisana kao vlasnica OPG-a. Istragom je, međutim, utvrđeno da je u vrijeme podnošenja zahtjeva ona već bila napustila Hrvatsku te da više nije bila uključena u djelatnost OPG-a.

Zbog statusa „mladi poljoprivrednik“ koji je imala njegova kćer, temeljem ta dva zahtjeva predana u ime OPG-a, optuženik bi dobio dodatnih 121 764 eura poticaja. 

Bespovratna sredstva dodjeljivana su kao potpora ulaganjima u poljoprivredna gospodarstva, a sufinancirana su iz Europskog poljoprivrednog fonda za ruralni razvoj (EPFRR) Unije po stopi od 85%, te Državnog proračuna Republike Hrvatske po stopi od15%.

Za predmetno kazneno djelo subvencijske prijevare predviđena je kazna zatvora do deset godina, a za krivotvorenje isprave do tri godine zatvora.

EPPO je neovisni ured javnog tužitelja Europske unije. Odgovoran je za istragu, kazneni progon i podizanje optužnice za kaznena djela protiv financijskih interesa Unije.
