Spain: EPPO dismisses case regarding the supply of protective masks in Madrid

On 6 March 2023, the European Public Prosecutor’s Office (EPPO) decided to dismiss the proceedings concerning the contract for the supply of 250 000 FFP2-3 masks for a total amount of €1 512 500, awarded by the Madrid Health Service (SERMAS: Servicio Madrileño de Salud de la Comunidad de Madrid). This decision was taken by the Permanent Chamber in charge, based on the proposal from the European Delegated Prosecutors and with the agreement of the supervising European Prosecutor, Ms Concepción Sabadell.

After an exhaustive investigation carried out by the European Delegated Prosecutors, the proceedings were dismissed because of a lack of relevant evidence. Throughout the investigation, the European Delegated Prosecutors took several statements; analysed the documentation provided by the declarants; checked the authenticity of the photographs of the masks delivered; requested information from various entities such as the Tax Agency, the SERMAS and the Spanish Association for Standardisation and Certification (AENOR); requested reports from the Civil Guard and appointed an expert to examine the documentation.

The proceedings have been dismissed as it has not been proven that the price paid for the masks was disproportionate in relation to the quality of the material offered and delivered, nor that it had suffered an undue increase due to the intervention of persons outside the company. Finally, it has been proven that the transport was paid by the awarded company, and not by the Community of Madrid.

Within the EPPO, the Permanent Chambers are a key element in guaranteeing the independence of all investigations. They monitor the actions taken throughout the investigation and decide on all the important steps, including whether to prosecute, dismiss or apply a simplified procedure. Concretely, the proposal of the European Delegated Prosecutors to dismiss this case has been assessed and validated by three European Prosecutors from a different Member State.

 

España: La Fiscalía Europea archiva el caso de las mascarillas de Madrid

El pasado 6 de marzo La Fiscalía Europea acordó el archivo del procedimiento referido al contrato de suministro de 250.000 mascarillas FFP2-3 por un importe total de 1.512.500 € adjudicado por el Servicio Madrileño de Salud de la Comunidad de Madrid (SERMAS). Esta decisión se tomó por la correspondiente Sala Permanente, a propuesta de los Fiscales Europeos Delegados y con el acuerdo de la Fiscal Europea supervisora, Concepción Sabadell.

Tras una exhaustiva investigación en la que los Fiscales Europeos Delegados tomaron diversas declaraciones; analizaron la documentación aportada por los declarantes; comprobaron la autenticidad de las fotografías de las mascarillas entregadas; requirieron información a diversas entidades como la Agencia Tributaria, el SERMAS y la Asociación Española de Normalización y Certificación (AENOR); recabaron informes de la Guardia Civil y nombraron un perito que examinó la documentación, se ha archivado el procedimiento por no concurrir indicios suficientes de la comisión de un delito

En particular, no ha quedado acreditado que el precio abonado por las mascarillas fuera desproporcionado atendida la calidad del material ofertado y entregado ni que hubiera sufrido un incremento indebido derivado de la intervención de personas ajenas a la empresa. Finalmente, ha quedado acreditado que el transporte fue abonado por la empresa adjudicataria y no por la Comunidad de Madrid.

En la Fiscalía Europea las Salas Permanentes son un elemento clave en la garantía de la independencia de las investigaciones. Supervisan las investigaciones y emiten las decisiones más relevantes, incluyendo las de acusar, archivar o aplicar un procedimiento simplificado. En particular, la propuesta de los Fiscales Europeos Delegados de archivar este caso ha sido valorada y confirmada por tres Fiscales Europeos de diferentes Estados Miembros.
