(Luxembourg, 2 May 2024) – At the request of the European Public Prosecutor’s Office (EPPO) in Zagreb (Croatia), a former Deputy Minister at the Ministry of Culture and Media, currently Chief Conservator at the Directorate for the Protection of Cultural Heritage, was arrested today on suspicion of corruption, in an investigation into the Faculty of Geodesy of the University of Zagreb. The former dean of the Faculty of Geodesy and a former professor at the same faculty were also arrested today.
The facts date back to the time of the earthquake that struck Zagreb on 22 March 2020, causing serious damage to cultural heritage buildings. The then Deputy Minister at the Ministry of Culture and Media was appointed team leader of a survey to identify the buildings damaged by the tremor, which involved the three-dimensional documentation of the destruction.
According to the investigation, the former Deputy Minister agreed with the dean of the Faculty of Geodesy to entrust these documentation tasks to the Faculty, in return for a monetary reward. It is understood that he, as a public official of the Ministry of Culture and Media, had prior knowledge that the Faculty did not have sufficient trained staff or equipment to perform such tasks, and that they would hire a company to perform them. Based on the evidence, that company was controlled by the dean and the professor, who were the true beneficiaries of the arrangement.
It is understood that, in agreement with the former Deputy Minister, the Faculty of Geodesy issued invoices to the Ministry of Culture and Media at a much higher price than the price at which the same work would have been performed by companies with the necessary staff and equipment. The investigation also showed that the former Deputy Minister certified, without carrying out adequate checks, the reports on the completed tasks submitted by the dean, on behalf of the Faculty. Based on the evidence, those reports falsely claimed that certain buildings had been scanned, or listed buildings that had already been paid for in earlier reports.
As a result, based on three reports thus approved, payment was made by the Ministry of Culture and Media to the Faculty of Geodesy to the amount of over €2.5 million.
In 2021, as part of that €2.5 million, around €800 000 was charged to the European Union Solidarity Fund (EUSF), and afterwards, due to the failure to have carried out an appropriate public procurement procedure, on 31 December 2023, this amount was instead charged to the State Budget of the Republic of Croatia.
The former Deputy Minister also approved the payment of a fourth report submitted by the dean, to the amount of €3.2 million, allegedly without adequate checks. However, this payment was not executed, as civil servants at the Ministry of Culture and Media found out that this report included buildings that had previously been submitted.
According to the investigation, the dean and the professor used part of the funds for their own benefit, obtaining undue pecuniary gain for themselves and others, to the amount of at least €384 000. They allegedly paid the then Deputy Minister a total of €39 000 and gave him an Apple Watch, worth around €370, as bribes.
It is estimated that the overpayment for the work caused a damage of over €1 million to the State Budget of the Republic of Croatia, on account of the inflated prices. Due to the poor work performed and, in some cases, the absence of three-dimensional scans, the tasks had to be performed again by other companies, which led to further costs. For this reason, an additional €31 681.39 had to be paid, causing damage to the EU Solidarity Fund, which financed these additional works, to the amount of €17 699.70, and to the State Budget of the Republic of Croatia, to the amount of €13 981.68.
Today’s arrests follow investigative activities conducted in cooperation with the Independent Financial Investigation Sector of the Croatian Ministry of Finance’s Tax Administration and the National Police Office for the Suppression of Corruption and Organised Crime (PNUSKOK), which had led to searches at the Ministry of Culture and Media on 14 February 2024, and to previous arrests on 8 November 2023.
The EPPO is the independent public prosecution office of the European Union; it is responsible for investigating, prosecuting and bringing to judgment crimes against the Union’s financial interests.
Hrvatska: Bivši pomoćnik ministra uhićen u istrazi koja uključuje Sveučilište u Zagrebu
(Luxembourg, 2. svibnja 2024.) – Na zahtjev Ureda europskog javnog tužitelja (EPPO) Zagrebu (Hrvatska), danas je uhićen bivši pomoćnik ministra u Ministarstvu kulture i medija, sada Glavni konzervator u Upravi za zaštitu kulturne baštine, zbog sumnje na korupciju, i to u sklopu istrage na Geodetskom fakultetu Sveučilišta u Zagrebu. Danas su uhićeni i bivši dekan Geodetskog fakulteta te bivši profesor na istom fakultetu. Protiv sve trojice EPPO je donio rješenje o proširenju i provođenju istrage.
Naime postoji osnovana sumnja da je tadašnji pomoćnik ministra u Ministarstvu kulture i medija, nakon što je 22. ožujka 2020. područje Grada Zagreba, Krapinsko-zagorske županije i Zagrebačke županije pogodio potres koji je uzrokovao velika oštećenja na zgradama kulturne baštine, bio imenovan čelnikom tima za pregled i identifikaciju zgrada oštećenih potresom, što je uključivalo trodimenzionalno dokumentiranje oštećenja.
Koristeći opisanu situaciju i svoj službeni položaj, bivši pomoćnik ministra je s dekanom Geodetskog fakulteta dogovorio da će se poduzeti sve potrebne radnje kako bi Ministarstvo kulture i medija na poslovima popisa i procjene šteta na nepokretnim kulturnim dobrima prouzročenim potresom, angažiralo navedeni Fakultet, u zamjenu za novčanu nagradu i druge poklone. Naime, bivši pomoćnik ministra je, kao dužnosnik u Ministarstvu kulture i medija, znao da Fakultet nema dovoljno osposobljenog kadra ni opreme za obavljanje takvih poslova, te da bi za njihovo obavljanje angažirali jedno trgovačko društvo. Dokazi pokazuju da su to trgovačko društvo kontrolirali dekan i profesor, koji su bili stvarni korisnici ovoga aranžmana.
Postoji osnovana sumnja da je u dogovoru s bivšim pomoćnikom ministra Geodetski fakultet Ministarstvu kulture i medija dostavljao izvješća po znatno višoj cijeni od cijene po kojoj bi iste radove obavile tvrtke s potrebnim kadrovima i opremom. Istraga je pokazala i da je bivši pomoćnik ministra bez ikakve odgovarajuće kontrole potvrđivao izvješća o obavljenim radovima koja je podnosio dekan u ime Fakulteta. Prema pribavljenim dokazima, ta su izvješća lažno navodila da su određene zgrade snimljene ili su pak navodila zgrade za koje su plaćanja već bila izvršena na temelju ranijih izvješća.
Slijedom toga je, na temelju tri tako odobrena izvješća, Ministarstvo kulture i medija izvršilo plaćanje Geodetskom fakultetu u iznosu od preko 2,5 milijuna eura.
U 2021. godini, od tih 2,5 milijuna eura, iznos oko 800.000 eura knjižen je na teret Fonda solidarnosti Europske unije (FSEU), a potom, zbog neprovođenja odgovarajućeg postupka javne nabave, dana 31. prosinca 2023., taj je iznos preknjižen na teret Državnog proračuna Republike Hrvatske.
Bivši pomoćnik ministra je bez odgovarajuće provjere odobrio plaćanje i na temelju četvrtog izvješća koje je podnio dekan, u iznosu od 3,2 milijuna eura,. Međutim, to plaćanje nije izvršeno, jer su službenici Ministarstva kulture i medija utvrdili da su u tom izvješću navedene zgrade koji su već bile uključene i plaćene u ranije dostavljenim izvješćima.
Istraga je pokazala da su dekan i profesor koristili dio tog novca za svoju korist, čime su priskrbili nepripadnu materijalnu korist sebi i drugima, i to u iznosu od najmanje 384.000 eura. Za opisano dogovoreno postupanje u više navrata su pomoćniku ministra kao mito predali iznos od najmanje 39.000,00 eura, te pametni sat Apple Watch, u vrijednosti oko 370 eura.
Smatra se da je preplaćivanjem radova zbog prenapuhanih cijena nanesena šteta Državnom proračunu Republike Hrvatske od preko milijun eura. Zbog loše obavljenog posla i, u nekim slučajevima, nepostojanja trodimenzionalnih snimki, te su poslove morale ponovno obavljati druge tvrtke, što je dovelo do dodatnih troškova. Zbog toga je trebalo platiti dodatnih 31.681,39 eura, čime je nanesena šteta Fondu solidarnosti Europske unije, iz kojega su se financirali ti dodatni troškovi u iznosu od 17.699,70 eura, kao i Državnom proračunu Republike Hrvatske, u iznosu od 13.981,68 eura.
Današnja uhićenja rezultat su istražnih radnji provedenih u suradnji sa Samostalnim sektorom za financijske istrage Porezne uprave Ministarstva financija i Nacionalnim policijskim Uredom za suzbijanje korupcije i organiziranog kriminaliteta (PNUSKOK), koje su ranije dovele do pretraga u Ministarstvu kulture i medija 14. veljače 2024. kao i do prethodnih uhićenja 8. studenoga 2023. godine.
EPPO je neovisan ured javnog tužitelja Europske unije. Odgovoran je za istragu, kazneni progon i podizanje optužnice za kaznena djela protiv financijskih interesa EU-a.
